The Government of Barbados by the death of the
Lord Willoughby being devolved to the councell of that
Island they for orders sake chose Sr Peter Colleton to
bee president of the Councell

Whilst hee was thus president the Affrican company
factors made complaint by petition that one John
Price had been tradeing to the coast of Affrica
contrary to his Majestys Charter & to law, & desired
that his Majestys Atturny of that Island might bee
ordred to enter an Information against him in
the Exchecker there, & that Price might bee taken
into Coustody vntill hee gave in security to answeare that
said Information, which the councell granted as deeming it
according to the practice & vsage there,

Sr Peter Colleton beeing a member of the Affrican
^ company & to a party, refused to giue his judgement in this case,
however the order granted by the councell Issued in the
vsuall stile which was (by the president & councell) &
Price as hee alleadgeth was taken into coustody vpon
it, for which hee hath brought an action of false Imprisonment
against Sr Peter Colleton in the Kings Bench

If it shall bee adjudged that a member of the councell
of Barbados shall bee lyable to bee tried here for an order
of councell made there, though it cannot bee proved that
his consent was to the order, then will it bee very vnsafe
for any man that hath an estate in England as well as in
Barbados to bee of the councell there, for hee may bee
sued here for things done there which hee consented not
to, & that place of great trust will in time come to bee
executed by none but such as haue no Estates ^ or interest in England
& by consequence loose nothing if the Island change
masters

This action as I am Informed is carryed on at the [illegible]
